DR ‹ › Morocco-focused potash developer Emmerson PLC said on Monday it had submitted a $1.215 billion damages claim, including interest and net of local taxes, in its arbitration case against Morocco. The dispute stems from Morocco's rejection of the Khemisset potash project in December 2024, after authorities cited environmental concerns, particularly water usage. Emmerson argues the move breached its rights under the UK–Morocco Bilateral Investment Treaty (BIT). The company said it had reached an advanced stage of development before the alleged breaches and has appointed independent experts to assess the value of its claim. With its Memorial now submitted, the arbitration process moves to the next phase, during which Morocco will have several months to respond. «The submission of the Memorial is a significant step», CEO Graham Clarke said. The case was formally filed on April 30, 2025, by Emmerson subsidiaries Khemisset UK Ltd. and Potasse de Khemisset S.A. before the International Centre for Settlement of Investment Disputes (ICSID). The claim alleges expropriation of the project and failure to provide fair and equitable treatment, protection, and non-discriminatory conditions for the investment.
